Terms of service

1. The agreement

These terms cover your use of artCart.AI ("the service", "we", "us"). Creating an account means you accept them. If you do not, do not use the service.

2. Your account

• You must be old enough to enter a contract where you live.
• Provide accurate registration details and keep them current.
• You are responsible for keeping your password secure and for everything done under your account.
• One person or business per account. Do not share credentials.
• Tell us promptly if you believe your account has been accessed by someone else.

3. Credits and payment

• Credits are purchased up front and spent when AI images are generated.
• Credits do not expire and have no cash value outside the service.
• Credits are deducted only when images are successfully produced. Failed generations are not charged.
• Prices may change. Changes do not affect credits you have already bought.
• Payments are processed by third-party providers under their own terms.
• Refunds on unused credits are considered case by case. Contact us.

4. AI-generated content

Images are produced by third-party AI models. This matters in several ways:

• Each model provider sets its own terms for commercial use of its output, and those terms change. You are responsible for checking the terms of the model you used before selling work made with it.
• We do not guarantee that generated images are unique. Similar prompts can produce similar results for different people.
• We do not warrant that generated content is free of third-party rights claims.
• Providers apply their own content filters. A prompt may be refused for reasons outside our control.
• Availability of any particular model depends on the provider and may change or end without notice.

5. Your content and your store

• You retain whatever rights you hold in the artwork, text and images you upload or generate.
• You grant us the limited licence needed to host, process and display that content in order to run the service and your storefront.
• You are responsible for what appears on your store, including product descriptions, pricing, tax obligations and any claims you make.
• You are the seller of record for your sales. We do not take commission and are not party to your transactions with your customers.
• You are responsible for fulfilling orders and for handling your customers' refund and dispute requests.

6. Acceptable use

You may not use the service to create, host or sell:

• Content that infringes someone else's copyright, trademark or other rights.
• Sexual content involving minors, or non-consensual intimate imagery.
• Content that harasses, defames or incites violence against people or groups.
• Deceptive imagery of real people presented as genuine, or fabricated documents and records.
• Anything unlawful where you or your customers are located.

You also may not attempt to disrupt, reverse engineer, overload or gain unauthorised access to the service, or to extract our provider credentials.

7. Suspension and termination

• You may close your account at any time. Contact us and we will help you export your catalogue.
• We may suspend or terminate accounts that breach these terms, and will give notice and an opportunity to put things right where it is reasonable to do so.
• Serious breaches — particularly under acceptable use — may result in immediate termination without refund.

8. Availability

We aim to keep the service running continuously but do not guarantee uninterrupted availability. Maintenance, third-party provider outages and circumstances beyond our control can all cause interruptions. We are not liable for losses arising from downtime.

9. Liability

The service is provided as is. To the fullest extent permitted by law we exclude implied warranties, and our total liability arising from the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost sales or indirect losses. Nothing here limits liability that cannot lawfully be limited.

10. Changes

We may update these terms as the service develops. Material changes will be notified through the service or by email. Continuing to use artCart.AI after a change means you accept the updated terms.
